AFTER THE CRIME: Investigation
During the conducted investigation, it was established that the defendant Luković Milorad - Legija and the now deceased Dušan Spasojević in 1999 created - organized a gang whose aim was to commit criminal acts provided for by the law of the Republic, for which a prison sentence of 5 years or more can be imposed punishment. The goal of this gang was to achieve financial and other benefits and power by committing criminal acts, which included the need to eliminate all competing clans and persons who would be a hindrance to the activities of this gang. In this criminal organization, the members had predetermined roles, which were strictly controlled by the organizers, the activity itself was planned for a long time and with the observance of strict rules of internal discipline, where the exact place of each member of this gang was known in the hierarchy. In that pyramid, the elders of the district are at the head. Luković - Legija and Dušan Spasojević, who as organizers had unlimited power, both in terms of planning the activities of the organization and in terms of issuing direct and concrete orders to individual members of the organization. The whole organization was conceived so that after acquiring certain financial and other social power, with the support of the Special Operations Unit, which was then headed by District The Legion, and using the positions that the gang would achieve in certain social, political, judicial and other factors, directs its activity in the direction of winning power. This meant, first of all, introducing instability into the existing government, eliminating certain individuals as holders of that authority, changing the personnel structure in important segments of the government, all of which would enable this organization to definitely win power. In this whole idea, the fact of the existence of Hague indictments against certain persons was used, in order to set the front of the organization's activities more broadly and to have behind it the support of a large number of people who had a negative attitude towards the existence of the Hague court.
Trained i obedient JSO
Considering that the government could not be won by legal means, especially not from the criminal organization of Spasojević and Luković - Legija, the idea is to include the JSO unit in the implementation of that plan as an armed formation that is well trained and obedient in relation to Luković - Legion.
The realization of the plan could only be achieved by weakening the existing government, which would consist in the murder of both the Prime Minister and other high-ranking federal and republican officials. In this way, a feeling of insecurity would be created and a suitable ground would be created to carry out the final intervention towards the conquest of power precisely through the action of JSO. The first "test" of those ambitions was the JSO rebellion, which also had a political background through its demands for the dismissal of the Minister of Police and other persons. This action had a limited scope, because only some personnel changes were forced in the MUP of Serbia, but even such scopes encouraged Spasojević and Legija to push the basic idea - the conquest of power, but now in a different way and with other means. To that end, the first obstacle was Prime Minister Zoran Đinđić, on whom they could not have any influence or even contact. Since the realization of that idea required a larger number of participants, Spasojević and Legija organized a conspiracy of existing loyal members of the criminal association and verified members of the JSO. In this way, the members of that conspiracy, which basically had the goal of endangering the constitutional security of the FRY, become defendants from the provision of the spring under I point 1. Further implementation of the plan required the existence of an action plan and the distribution of certain responsibilities of the members in the sense that in the organization of the deceased. Spasojević and Luković - Legija undertook specific activities that are described in detail in the disposition of this indictment.
After undertaking these activities, we moved on to the concrete realization of the plan, which is the taking of Zoran Đinđić's life.
Failed actions
After they chose district as the perpetrator of the assassination. Jovanović as a sniper and Tojag Željko as a "zoljaša", Luković and Spasojević planned and agreed with them in Brzeć and Belgrade at the beginning of February 2003 that with the participation of other members of the gang with precisely defined tasks on 16.2.2003. year, when the Prime Minister was returning from Kopaonik, on the hill above Bubanj Potok, he carried out an assassination by stopping the column containing the Prime Minister by Miloš Simović and Dejan Milenković, who would be driving the previously acquired trucks, and Jovanović and Tojaga shoot at the Prime Minister's vehicle from "Zolje". Other members of the conspiracy had pre-determined tasks related to monitoring the movement of the Prime Minister's column, providing fire support and extracting the immediate perpetrators from the scene. As this action did not succeed, as did the preparations to carry out the assassination at the Federal Assembly during the proclamation of the State Union of Serbia and Montenegro, a plan was adopted to do so on 21.2.2003. on the Belgrade-Zagreb highway, near the "Limes" hall. Previously, district Bezarević via district Dejan Milenković and Miloš Simović conspiracies, provided information about the Prime Minister's travel time, travel routes and cars in which the Prime Minister would be. In this action, the members of the conspiracy also had precisely defined goals and tasks that were described in detail in the enacting terms of the request, while the entire action was directly managed by district Luković - Legija and deceased. Dušan Spasojević through district Miloš Simović, and this one with other members of the conspiracy. The idea was basically the same as with the events of February 16.2.2003, XNUMX. year, because on the embankment next to the highway were arranged okr. Jovanović Zvezdan and Tojaga Željko armed with "zolja", as well as Kalinić Sretko with deceased. Luković - Kum, who were armed with automatic weapons and aimed at providing fire support. Other members who, in addition to the previous security measures, required technical means and conditions, had specific tasks to monitor the Prime Minister, provide security for the immediate executors, protect them, etc. The individual actions of those participants are explained in detail in the disposition of this indictment.
However, even this action did not succeed due to poor communication between the members of the conspiracy, so Dejan Milenković, when the Prime Minister's column of vehicles approached, cut off the Prime Minister's column of vehicles with the truck he was driving in the immediate vicinity of the "Limes" sports hall. , but due to the skillful reaction of the driver of the Premier vehicle, the contact and the accident were avoided.
After this, it became clear that the assassination could not be carried out in this way in order for the organizers of the conspiracy to accept the proposal of the district. Jovanović Zvezdana to carry out the assassination by shooting from a sniper rifle. To that end, it was first necessary to secure a suitable location from which the assassination could be carried out. The district took part in finding the location. Krsmanović, Simović Aleksandar, Jovanović Zvezdan and Konstantinović Ninoslav. After scouting several locations, the choice fell on Admirala Geprat Street and the window of office number 55 on the second floor. In order to implement this plan, the members of the conspiracy were arranged, which will be discussed later, so that the district Jovanović together with district Konstantinović Ninoslav and Aleksandar Simović came to this office on March 10 and 11.3.2003, 12.3.2003. year, waiting for the arrival of the Prime Minister in the Government building, but he did not appear in the Government those days. Finally, on March 12.35, 14. around 259:XNUMX p.m., when Miloš Simović informed Aleksandar Simović that the Prime Minister was coming to the Government building, and at the moment when he got out of the official car and walked towards the front door of the Government building, Jovanović Zvezdan fired two projectiles from the sniper rifle "Heckler and co. one of them hit the Prime Minister in the right side of the chest, causing him a gunshot wound that resulted in his death, while the other projectile caused a serious bodily injury in in view of the gunshot wound to the pelvic part of the body of the security guard of the Prime Minister Milan Veruović. This was preceded by the provision of a parking space in front of the building in Admirala Geprata Street number XNUMX by the district. Jurišić Milana, who gave the parking space to the district. Milosavljević to Vladimir, driver of district Jovanović, Konstatinović and Aleksandra Simović. Konstatinović Ninoslav first entered this office carrying a spool of cables imitating the execution of works in the building, and when he was sure that there were no third parties in that room or in the corridor, he called the district. Jovanović and Aleksandar Simović, who was carrying a sniper rifle in his bag, when they entered this room. By the way, in addition to the sniper rifle, all three defendants were armed with pistols. After firing round. Jovanovic threw the rifle around. Simović Aleksandr, so all three of them ran out of the building to the street where Milisavljević Vladimir was waiting for them with the engine of a "Passat" car with Pancevo registration running, from where he transferred them to a garage in New Belgrade. From there, according to the previously achieved plan, they were taken to pre-rented apartments, so-called. "stekes", which were rented by the district for that purpose. Miladin Suvajdzic. Thus, from that garage to the location at Vojvode Stepe Street number XNUMX, the district was transferred. Jovanović, district Kalinić and Luković - Kum, while they were transferred to another apartment - "štek" district. Milisavljević, Simović, Miloš and Aleksandar and Konstatinović Ninoslav.
Incomplete facts
Therefore, on the basis of these statements, the place where the Prime Minister was at the time of the assassination, as well as his position in relation to the mouth of the pipe from which the firing was carried out, is determined. The statements of these witnesses about the circumstances related to the place and position of the deceased. The premiere, which was the subject of speculation, is completed by the findings and opinion of experts Dr. Dušan Dunjić and Milan Kunjadić. Their conclusion is that the deceased. At the time of injury, Đinđić was in the immediate vicinity of the entrance door to the Government building, with his back to that door and leaning on his right leg and crutches, and that his right side and the front of his body were facing Admirala Geprat Street, where the projectile came from. This finding and conclusion to a certain extent discredits the finding of experts from Germany who determined the landing point of the Prime Minister at the time of injury by moving it away from the front door and towards the car. However, bearing in mind that the findings of the experts from Germany were given on the basis of incomplete facts, because they did not have at their disposal all the evidence that was collected later (witness statements, etc.), the place they chose as a landing point, does not correspond to traces of damage to the Government building, nor traces of blood that were found at that place - the landing point, originating from the injured Veruović. The very trace of damage, on the wall of the building at the entrance to the Government, originates from a projectile that hit the injured Veruović, for which these experts provide logical, solid arguments and conclusions in their findings.

It follows from the attached written documentation that the "Heckler and koh" brand rifle was found buried by stones on a field in New Belgrade. Information about where the rifle could be hidden comes from the district. Suvajdžić Miladina, about which he spoke in detail when he was questioned as a defendant. According to the findings of the experts from Germany, it follows that according to the traces found at the scene, the window of office number 55 is the possible place from which the shooting took place. This, both in view of the position of the shell casings found on the spot, and in view of the fact that traces of gunpowder particles were found on the blanket from the window of the building in Admirala Geprata Street number 14. The disintegration of the shell casings, which was carried out in laboratory conditions, confirms the possibility that the shell casings fired from this weapon were found in the place where they were found. With a further and deeper analysis, the experts find, as it is claimed on page 20, that two shots - projectiles, bearing in mind all the found and fixed material traces, were fired from the window of office number 55 in Admirala Geprat Street. Such a conclusion is identical to the findings of the Department of Crime. SUP Belgrade technicians that the shells found on the spot as well as the shells found on Fruška Gora during the shooting of the rifle (about which there is a record of the District Court from Sremska Mitrovica) were fired from the "Heckler and koh" brand rifle that was found.
Also found on this rifle were 6 polyacryloniril fibers originating from the blanket found on the window. Also, according to this finding, traces of debris from the blanket could have been created when the ammunition in question was fired. If we explain all this, we come to the unequivocal conclusion that the Prime Minister was shot from the window of building number 55 from a rifle found in New Belgrade.
Witness Škena Nenad claims that this rifle was acquired from the JSO by the district. Milorad Luković - Legija and that he handed it over to the defendant Jovanović. The aforementioned witnesses say that the persons who ran out of the building at Admirala Geprat Street number 14 were carrying a rifle, which all link the location of the shooting, the origin of the rifle and the place where it was found and lead to the conclusion that the act of assassination itself was carried out with this weapon.
Analysis DNK u toku
After summarizing and analyzing the technical details, the basic question arises - is there any evidence for the claim from the spring that the district Jovanović shot at Zoran Đinđić and Milan Veruović. Since DNA analyzes did not give a definitive answer to this question (some are still in progress), we must rely on the statements of the defendants and witnesses to answer this question. Namely, district Jovanović Zvezdan was interrogated as a suspect according to the provisions of the CPC, he resolved that dilemma by explicitly claiming that he personally killed the Prime Minister, explaining the circumstances and details of the event itself. Okr. Suvajdžić states that the district Jovanovic immediately after the assassination video with the deceased. Kum and Luković, and the next day in the apartment at 259 Vojvode Stepe Street also, when he heard Kum's comment that referred to Jovanović and which read "Ala je zašio him".
District Krsmanović confirms that the district Jovanović persuaded Spasojević and Legija that the most suitable way to carry out the assassination was shooting from a sniper, considering that previous attempts on the highway had failed. This witness also confirms the fact that district Jovanović visited the locations that were wanted for the execution of the assassination and that he said that the chosen location in Admirala Geprata Street was suitable for him. He further confirms that he saw Jovanović when he came with Tojaga Željko from Kopaonik to an agreement with Spasojević and Legija before the event of 16.2.2003. year.
The death of Prime Minister Đinđić, as well as the serious bodily injuries of the injured Veruović, are established on the basis of the autopsy report for the deceased. Đinđić, medical documentation and findings and opinions of forensic medicine experts. On the basis of these documents, both the mechanism and the dynamics of the injuries that occurred in the case of the deceased are determined. Đinđić was killed and the victim Veruović was seriously injured. These findings fit with the technical details and assessments from the findings of ballistics experts and other written documentation and as a whole provide answers to questions related to the manner and dynamics of the critical event.
Therefore, on the basis of these statements, technical data and the findings and opinions of experts, it can be safely asserted that the district Jovanović, the person who shot and killed Prime Minister Đinđić and tried to take the life of Milan Veruović.
Power i power
In relation to the district Milorad Luković - Legion and the actions that are charged to him, both in connection with the organization of the association to carry out hostile activities, and the assassination itself, are the claims of the defendants Miladin Suvajdžić, Dušan Krsmanović, Zoran Vukojević, and to some extent Saša Pejaković, on the basis of which can claim that the district Luković - Legija was the organizer of both a criminal association under Article 227 of the Criminal Code of the RS and an association for the purpose of hostile activity under Article 136 of the Criminal Code of the Republic of Serbia. It also follows from the statements of those persons that the district Luković - Legion, in addition to obtaining technical means, directly organized, planned and directed the assassination of the Prime Minister. The goals of the organization from Article 227 of the CC of the Republic of Serbia, as well as the association from Article 136 of the OKZ, are also determined by the statements of these persons. It unequivocally follows from them that the basic idea was the creation of financial and other power, which over time, with the increase of appetite, turned into the idea of conquering power.
When it comes to the other defendants, their role, the actions they took, are also determined based on the testimony of these persons. Okr. Suvajdžić and district Krsmanović explained the roles and actions of these persons in detail, and they coincide with the real development of events, as well as with material evidence. In this direction, the circumstances related to rented apartments, which were discussed by the district, should be highlighted. Suvajdžić Miladin, where in a certain number of cases the crime by technical processing of the crime scene and analysis of papillary lines, it was established that the defendants from paragraph I of the indictment resided in those apartments. Those technical details confirm the statement of district. Suvajdžić, as well as district Krsmanović as credible and round both the technical and logical event into one whole.
Demonstration sile
In relation to the event of 21.12.2002. year from the attached technical documentation and statements of district Suvajdžić and district Krsmanović, it follows that the district Milorad Luković - Legija and Dušan Spasojević, for the sake of a demonstration of force, decided to destroy the plant of the "Defense Road" Company, owned by Ljilja Buha, whose real owner is district Ljubiša Buha - Plagues. To that end, the district was engaged. Krsmanović, Jurišić, Milisavljević, Simović Miloš and Aleksandar, Milenković Dejan, Suvajdžić and Pović, who, with the participation of Milorad Luković - Legion and several members of the JSO, planted explosives in the premises of the "Defense Road" company, which activated the plant to a considerable extent destroyed and caused material damage in the amount of about 8.300.000 EUR.
This factual situation is established on the basis of the statement given by the district. Suvajdžić Miladin, testimony of district Dušan Krsmanović, the attached technical documentation and based on the testimony of the witness of the worker of the "Defense Road" Company.
Namely, according to the testimony of the defendants Suvajdžić and Krsmanović, it follows that the plan to destroy the "Defense Road" plant was created by the defendant Milorad Luković - Legija and Dušan Spasojević, who was motivated not only by personal motives but also primarily by a demonstration of force, so that the government realized that they, i.e. the organization of Luković and Spasojević can do anything, for which purpose they undertook the action of destroying the technical facilities of this company. The role of individual persons from the provisions of the indictment is supported by the statements of the defendants, as well as the statements of witnesses Svetozar Batanjac, Stojadinović Dragoslav, Ristić Krunislav and Slobodan Todorović. All of them unanimously declare that the critical moments were unknown persons who came with two cars, one of which was with police plates and the other with civilian ones, first they were neutralized as security workers, they were taken out of the company, after which third parties came into the company , planted an explosive and after some time activated that explosive. The participation of persons named in the disposition of the indictment, as well as the perpetrators, is determined based on the testimony of district attorney. Suvajdžić and Krsmanović, and that narration connected with witness statements and material evidence undoubtedly creates a logical whole about the time, place and manner of the execution of this criminal act. As for the property damage caused by the execution of this criminal act, it is determined according to the statement of the District. Ljubiše Buhe in the amount of around EUR 8.300.000.

Also, according to the results of the investigation, it was determined that the plans of the district Luković - Legija and Dušan Spasojević in the direction of causing instability, i.e. creating a suitable terrain for the action of their organization planned, hired and implemented a plan to throw bombs at the premises of the DSS in Ulica Jug Bogdanova no. 2a. Milisavljević Vladimir, Krsmanović Dušan and Jurišić Milan were engaged for this purpose. Milisavljević is implementing the set plan on critical evenings, i.e. on 28.2.2002. drove Krsmanović and Milisavljević, who threw two hand grenades into the premises of the DSS and then drove away from the scene.
This factual situation is also determined on the basis of the full recognition of the district. Krsmanović, according to the testimony of district Suvajdžić, as well as on the basis of written documentation related to the technical details related to this act.
Furthermore, during the investigative procedure, it was established that the district Aca Tomić, Borislav Mikelić and Dragan Vujičić became members of the association for the purpose of carrying out hostile activities under Article 136, para. 2. in connection with para. 1. OKZ, by making direct contacts with the district. Luković - Legija and Dušanon Spasojević, undertaking actions that are described in more detail in the dispositive part of this indictment. That the defendants really undertook these actions, is established on the basis of the testimony or defense of the district. Suvajdžić, Krsmanović, Vukojević and others, who testified about the contacts the defendants had with Milorad Luković - Legija and Dušan Spasojević, also testifying about the content of those contacts.

In relation to the district Pažin Slobodan, during the investigation, it was established that he gave Spasojević and Milorad Luković - Legija information about the activities, actions, intentions and concrete moves of the GSUP regarding specific events, which not only made him a member of a criminal association, but also covered up the execution of certain criminal acts with his activities. act, specifically the criminal act of murder of the deceased. Petrović Marko "Mommy" when he gave specific instructions on how to proceed in order to erase the traces from the scene. Also, according to the state of the files, it follows that the district Pažin Slobodan had concrete and accurate information about the perpetrators of the crimes described in more detail in the indictment, but he did not report the perpetrators of those crimes to his service as a service for detecting both criminal acts and the perpetrator. In that direction, there are statements that district Miladina Suvajdžić, Ljubiše Buhe, Zorana Vukojević and others.
Heard during the investigation of district Suvajdžić Miladin and Krsmanović Dušan basically and in essential details admitted to the commission of the criminal acts charged against them, giving a whole series of details related to their activity as well as to the activity of other members of the criminal organization - conspiracy. District Jovanović Zvezdan was interrogated as a suspect before the authorities of the UB POK and gave a statement, where he practically admitted the commission of the criminal offense he was charged with. During the investigation, he defended himself by remaining silent, using his right not to declare his defense. District Saša Pejaković, Branislav Bezarević and Zoran Vukojević basically admitted objective facts related to specific actions and specific criminal acts. However, in their defenses, they tried to portray the critical events in the light of either random participants or persons who had no concrete knowledge of the foreseen and planned activities and persons who did not in any way participate in the actions they are accused of. Such defenses of the defendants should be rejected as unfounded, because they are aimed at avoiding criminal responsibility, and they also contradict the evidence that was collected during the investigation phase and proposed for presentation at the main trial. Okr. Mikelić Borislav, Tomić Aca and Dragan Vujičić did not admit to the crime they were charged with, but I consider their defense as unfounded and aimed at avoiding criminal responsibility, considering the evidence that was collected during the investigation phase and which points to the conclusion that these defendants in the manner, at the time and at the place as described in the dispositive provision of the defendant, they undertook actions that contain elements of the criminal offense charged against them.
Concealment murders
In relation to the district Pažin Slobodan, who defended himself by saying that he did not commit the crimes he is accused of, states that his defense has no basis in the factual situation that was gathered during the investigation and that as district Suvajdžić, Krsmanović et al., as well as the examined witnesses, and especially district Ljubiša Buha, point to him as the person who ganged up on the deceased. Spasojević Dušana and district Milorad Luković Legion gave information about the activities of the police, as well as the fact that, having knowledge of the perpetrators of the criminal acts of murder listed in the indictment, he did not report those classrooms to his service in order to take appropriate actions, which indicates that the district By committing or giving instructions on how to cover up a specific criminal act and by not reporting the perpetrators, Pažin committed the criminal acts charged in this indictment.
Members of the gang organized by the defendants Luković Milorad, Spasojević Dušan and Luković Mile committed several criminal acts of murder from Article 2000 of the RS CC and kidnapping from Article 2003 of the RS CC, described in points II B 47, in the period from 64 to the beginning of 1. - 13 indictments. In addition, the defendants Luković Milorad, Spasojević Dušan and Mile Luković directly participated in the execution of some of those criminal acts.
The decisive facts about the execution of the aforementioned criminal acts are established on the basis of the statements of the defendants Dušan Krsmanović, Miladin Suvajdžić, Saša Petrović, Milomir Kaličanin and Dragan Miladinović, witness statements, findings and opinions of experts and information provided in the documents submitted as evidence.
The defendants Nikola Bajić and Buha Ljubiša denied that they had committed the crimes they were charged with, while the defendant Slavković Đorđe defended himself by remaining silent.
Recalled recognition
The defendants Milomir from Kaličan and Dragan Miladinović admitted during the hearing before the internal affairs authorities that they had committed the crimes they were charged with. On that occasion, they explained that the other defendants also participated in the execution of the same criminal acts, in the manner described in the indictment. Presenting their defense before the investigating judge, they retracted their confessions before the internal affairs authorities. The defendant Milomir from Kaličan stated that the content of the record of his interrogation before the internal affairs body does not correspond to what he actually stated, because that record was prepared in advance by that body, while the defendant Miladinović Dragan stated that he did not freely give his testimony before the internal affairs body jobs.
The defendants Dušan Krsmanović, Suvajdžić Miladin and Saša Petrović admitted, in relation to all decisive facts, that they had committed the crimes they were charged with. At the same time, they explained that all the other defendants named in the indictment as perpetrators participated in the execution of the same criminal acts.
The content of the statements of the defendants Dušan Krsmanović and Miladin Suvajdžić is mutually agreed upon, even in relevant details. At the same time, their statements are in accordance with the original statements of the defendants Milomir Kaličanin and Dragan Miladinović, the statements of the heard witnesses, the findings and opinions of the experts, and the data stated in the documents that were proposed as evidence.
For the above reasons, the statements of the defendants Dušan Krsmanović, Miladin Suvajdžić and Saša Petrović, as well as the original statements of the defendants Dragan Miladinović and Milomir Kaličanin, should be taken as true, since the defense of the defendants Nikola Bajić and Buha Ljubiša before the investigating judge is completely unargued and as such calculated to avoid criminal liability.

From the factual situation presented above, it follows that the actions of the defendants have all the essential characteristics of the criminal acts described in more detail in the indictment, for the execution of which they are fully criminally responsible. Namely, when it comes to criminal responsibility, according to the findings and opinions of the expert - neuropsychiatrist, it follows that all the defendants except district Maletić Predraga, whose ability to understand the significance of his actions and manage his actions was significantly reduced, acted as sane persons. As for the form of culpability of the defendants, they committed these criminal acts with direct intent, bearing in mind the fact that when it comes to criminal acts from I, they all include the intention of a certain action, which also results in direct intent. In relation to the acts described under II, according to the established factual situation, it follows that all actions were undertaken with a purpose, after the adoption of appropriate plans and the undertaking of a whole series of activities for the realization of those plans, which also entails the existence of direct intent.
The proposal for the extension of detention was made bearing in mind the fact that the defendants Jovanović Zvezdan, Dusan Krsmanović, Saša Pejaković, Branislav Bezarević, Miladin Suvajdžić, Zoran Vukojević, Tojaga Željko, Ljubiša Buha, Nikola Bajić, Sasa Petrović, Đorđe Slavković, Milan Jurišić, Miladinović Dragan and Milomir Kaličanin are charged with the commission of a criminal offense for which, according to the law, a prison sentence can be imposed in duration of 40 years, so the conditions from Article 142, para. 1st point. 1. CPC. In relation to the other defendants, bearing in mind the gravity and nature of the criminal acts, I believe that there are reasons to, in the sense of Article 142 para. 2nd point. 2. The CPC extends detention.
