Trade Union Commissioner Electric utilities of Serbia (EPS) "Independence - branch of TENT" Dragoslav Ljubičić submitted to the First Basic Court in Belgrade a lawsuit for an administrative dispute in order to annul the decision on the termination of the employment contract.
Ljubičić's lawyer Ivan Ninić said, at a press conference in front of the courthouse, that a lawsuit was filed for reinstatement in EPS, because Ljubičić was one of the first to be fired after the protest of unions, employees and students in front of the EPS building, due to the alleged violation of the code of that public company, by postings on social networks.
His persecution began when he called citizens to a protest in front of the EPS. A day later, he received a decision on the termination of the employment contract, Ninic explained and added that the lawyers from EPS refused to "participate in this scandal", so the decision was written in the director's office.
Act of revenge
That's why it is requested to adopt a temporary measure by which Ljubičić returns to the post of dispatcher until the end of the administrative dispute.
According to Ninić, the dismissal is an act of revenge and an attempt to intimidate all EPS workers about what will happen to them if they dare to protest, especially if they advertise on social networks.
Ljubičić said that the dismissal decision, which he refused to sign, was posted on the company's bulletin board, and that he is now on sick leave, which will be terminated "by force of law".
The conference was also attended by Boris Tadić, former president of Serbia and leader of the extra-parliamentary Social Democratic Party of which Ljubičić is a member. Tadic said that they did not let him enter the court as a citizen, a witness.
EPS denials
Elektroprivreda Srbije denied the allegations of lawyer Ivan Ninić about the reasons for the termination of Dragoslav Ljubičić's employment contract.
"We emphasize that Ljubičić's employment contract was not canceled due to union activity or protest, but only and exclusively due to violation of the Code of Business Conduct, the Decision on Labor Discipline, and the Labor Law," the announcement states.
It is added that EPS is the most important energy company that ensures energy security in Serbia and respects the Labor Law that applies to all employees.
