The Assembly of the Bar Association of Serbia (AKS) voted by a majority of votes on Sunday for a 30-day suspension of work, lawyer Vladimir Terzić confirmed to the media.
"The most important thing is to point out that the legal profession has been attacked by the highest bodies of the executive power, that, beyond doubt, it is a fact that the court is under pressure from the government in order to make decisions that degrade the decisions of the bar association, because the executive power so wants and orders the court," the decision reads. Chamber of Advocates.
It is further stated that the legal profession in Serbia is in "seriously grave and imminent danger", and that the humiliation suffered by lawyers is "grave and unacceptable".
The decision of the AKS comes into force on Monday, February 3 and is valid until March 4, 2025.
In mid-January, the Bar Association of Serbia voted for a seven-day suspension of work, which was annulled by the High Court in Belgrade, after which the lawyers went on two suspensions of work for three days each.
One of the reasons for those work stoppages, as stated by the lawyers, was solidarity with the students who have been protesting for more than two months all over Serbia.
What will the strike look like?
That decision was made at the assembly of the Bar Association of Serbia, and in question was the proposal of lawyers from Šabac, while the proposal of the AKS itself for suspension of work for 15 days was overruled, portal 021 reports.
Šabac lawyers proposed establishing a minimum work process, so lawyers should not enter and stay in the premises of courts, prosecutor's offices, police and administrative bodies for any reason.
The request is also not to attend hearings for the main discussion and main trials before the courts, and lawyers should not approach the prosecution in investigative procedures and negotiation procedures regarding the application of opportunities or plea agreements. They would also not approach the police in pre-criminal proceedings.
During the suspension of work, lawyers will submit to the courts, prosecutor's offices and other authorities only appeals and lawsuits, the failure of which would cause the loss of a right.
Three-day work stoppage
As "Vreme" previously wrote, the Management Board of the Bar Association of Serbia made a decision to suspend work for three days: January 21, 22 and 23.
In the explanation of the decision, it was stated that this decision was made as a forced reaction to the decision of the High Court in Belgrade from January 20, which suspends the decision of the AKS from January 18 on the suspension of work.
It was assessed that the wording of the decision of the High Court is "unclear, contradictory, contrary to the explanation, and the decision itself is completely illegal".
Previously, on January 20, the High Court in Belgrade determined a temporary measure that annuls the decision of the AKS Assembly on the complete suspension of work for seven days and ordered a minimum of work in urgent cases. He reacted to the lawsuit of lawyer Goran Petronijević.
Ruling on the appeal of one of the members, the High Court in Belgrade on January 20 invalidated the part of the decision of the Bar Association of Serbia, which obliges the lawyers to complete suspension of work.
The Assembly of the Bar Association of Serbia previously passed a decision that determined the complete suspension of the work of lawyers in the entire territory of Serbia for seven days, from January 20 to 26.
