The Council of the Regulatory Body for Electronic Media (REM) today assigned national frequencies to television stations Prva, Pink, Happy and B92, which had them until now.
Because of this decision, the Slavko Ćuruvija Foundation and Crta will initiate legal proceedings against REM.
"With this decision, REM violated the provisions of the Rulebook by which it is regulated
procedure and criteria for issuing broadcasting licenses. Rulebook
is, among other things, defined that REM evaluates to what extent it is
the applicant complied with the program elaboration on the basis of which it was given to him
issued permit, as well as whether it is up to the moment of decision for the applicant
some of the measures provided by the Law were pronounced," their statement reads.
The Ćuruvija and Crta Foundation remind that "the expert service of REM, in reports on the monitoring of broadcasters, states years ago that these television stations do not comply with the elaborations on the basis of which they were issued a license, that they do not have mandatory program contents, and that they do not meet the minimum prescribed conditions for providing media services. A number of measures were imposed on the same broadcasters for violating legal provisions."
The Slavko Ćuruvija Foundation and CRTA will use all legal opportunities to initiate proceedings before the competent institutions against REM for non-compliance with the Law on Electronic Media and the decision-making criteria in the procedure for issuing a license based on the conducted public competition, which are precisely defined by the Rulebook.
Igor Božić, news director of N1, believes that "it is a clear political message - nothing is changing in Serbia, nor does anyone intend to change anything in terms of informing the public." He said that we can interpret that message so that the owners of the television stations that received national frequencies promised to continue working as before, and that "there is a certain future for the people who rule this country."
REM, also at today's meeting, decided that Hit Music FM, Radio S, Radio S2 and Play radio will receive licenses to provide media services for the whole of Serbia.
The rationale for these decisions will be available in the next few days, claims REM president Olivere Zekić, and suggests that everyone who is interested can see the elaborations.
Due to the great interest in obtaining a license for a national frequency, REM made a decision to announce a Tender for the award of another license, for the so-called "fifth frequency".
Olivera Zekić expects that the selection of television for the fifth frequency will be completed at the end of autumn.
The Council of REM also made a decision to call for a Tender for the allocation of licenses for the Belgrade region, namely three licenses for television broadcasting and 12 licenses for the provision of radio media services.
Given that these decisions "were made in a professional and responsible manner, in accordance with the democratic procedure", the REM Council "appeals to the broadest public and indicates the need to avoid any kind of manipulation and politicization in relation to the decisions made."
Televisions have the right to appeal the decision to the Administrative Court, but the Administrative Court cannot annul the REM decision, but only return it for reconsideration.
Let us recall that 14 television stations applied for the national television frequency - Pink, Happy, Nova S, N1, Prva, B92, TV Tanjug, Kurir TV, Kopernikus, TV K1, TV2, Vesti, BK and Una. Seven radio stations applied for national radio frequencies, namely Radio S, Radio Balkan, Radio Neven, National Radio Puls Grocka, Play radio, Radio S and Hit Music FM.
