"A few days ago, the CEC, in an unprecedented manner and contrary to the Law on General Elections, allowed the Serbian List to participates in the elections", announced on Thursday, January 2, Self-Determination Movement.
They announced that this party filed a complaint with the Electoral Panel for Appeals and Petitions, with a request to annul the decision on the certification of this party, writes the KoSSev portal.
"Making a decision on behalf of the CEC, but without the approval of the CEC, is a new attack on our legal order due to Serbian lists. Every decision of the CEC must be subject to a vote of CEC members. This decision cannot be attributed to the CEC, because it was not voted on. It is illegal, because it contradicts the Law on General Elections. The Serbian list was not authenticated in accordance with the law, but was illegally smuggled," said the ruling party in Kosovo.
"Terrorism Amnesty"
They said once again that the Serbian List "was and remains the party of the main terrorist (Milan) Radoicica".
"In the past, Radoičić used it against the state of Kosovo, and now it serves as a structure that protects and amnesties terrorism," said the Self-Determination.
Then they turned to the CEC, stating that it is an independent institution, which must protect the legal and constitutional order, but also "maintain its institutional integrity".
"It cannot be allowed to so brutally violate the Law on Elections and every regular practice, in order to make a place on the ballot for a structure that fights against the state of Kosovo and protects terrorists." Therefore, the Self-Determination Movement aims to cancel this illegal decision through this appeal, protect the legal order and prevent the verification of the Serbian list," they stated.
What happened?
On December 23, the Central Election Commission held a meeting where it decided on the confirmation of parties for the upcoming elections. Out of a total of 28 registered political entities, only Srpska List was not certified, after CEC members from Self-Determination expressed their opposition, while several other members, according to the media, were absent or abstained, reports KoSSev.
The non-verification decision caused an immediate reaction from international officials in Pristina, as well as leaders of international organizations, who expressed concern about the politicization of the verification process in the CEC.
Commenting on the non-confirmation of the Serbian List in the CEC, the Kosovo Prime Minister said that "no one should expect a different attitude from the members of Self-Determination in the CEC".
On the other hand, Serbian President Aleksandar Vučić, who previously predicted a similar scenario, reiterated that Kurti is trying to remove Srpska Lista as the only political opponent in Kosovo.
The president of the Serbian List, Zlatan Elek, accused the Prime Minister of Kosovo of trying to eliminate Serbs from political life, and this party filed a complaint with the Election Panel for Complaints and Petitions, which then approved it.
The Self-Determination Movement then sent an appeal to the Supreme Court against that decision, and on December 31, a confirmation arrived that the appeal was rejected, which was immediately welcomed by the EU Office in Kosovo.
A little later, the media in Pristina reported that the initial decision of the Appeals and Petitions Panel on the certification of the Serbian List was final, binding on the CEC, and that it was therefore not necessary to vote on it.
Self-determination obviously does not agree with this, for which the lack of voting is the reason for the complaint.
On the other hand, on December 31, several embassies in Kosovo welcomed the CEC's decision to confirm the Serbian list for the next Kosovo parliamentary elections, which will be held in February.
