"Vučić's prosecutors" experienced a debacle in the elections in To the High Prosecutorial Council on December 23, after which they filed numerous applications with the aim of canceling the elections. The next desperate move is an attempt to ban the already scheduled electronic session to decide on objections.
"The session cannot be held electronically, especially not on such important issues," Vujić pointed out. Ministry of Justice. He pointed out that the Rules of Procedure of the VST, in Article 29, stipulate that an extraordinary session of the VST can be held electronically due to urgency when the decision on the agenda does not require a discussion and review of the material.
"That is why it is inadmissible and contrary to positive regulations to schedule an extraordinary, electronic session by the President of the State Council of Justice, and to send emails asking the members of the Council to express their opinions on the items on the agenda within 24 hours from the moment of receiving the email," emphasized Vujić.
He warned that further insistence on violation of regulations could imply not only disciplinary, but also criminal responsibility of the President of the Council, who on several occasions, contrary to ethical norms, interfered in the election process by giving biased statements.
Electronic session already convened
As published on the VST website, Stamenković already convened an electronic session of the VST for today at 11:45 a.m. and stated that the reasons for the particular urgency of convening an extraordinary session are based on the provisions of Article 40 of the Law on the High Council of the Prosecution, and in particular the 48-hour deadline for making a decision on a complaint due to allegations of violation of electoral rights at the polling station.
Stamenković added that "deliberation of the extraordinary session by electronic means is ensured in accordance with the adopted practice of the Supreme Court of Justice that during the extraordinary session by electronic means all members of the Council have the right and possibility to discuss by electronic mail".
As a reminder, the portal N1 reported that due to the lack of quorum today at 10:00 a.m., the VST session was not held, where it was supposed to decide on prosecutors' objections to the elections for five new members of the VST from the ranks of public prosecutors at four levels, which were held on Tuesday, December 23.
The law stipulates that a quorum requires the presence of at least eight members out of a total of 11 members of the Council. Four members of the Council sent notices that they could not attend the extraordinary session today, and Stamenković said that some notices arrived too late.
The extraordinary session was not attended by members from the executive branch or close to it: Minister of Justice Nenad Vujić and two prominent lawyers Milan Tkalac and Vladimir Simić, which is about "Time" has already written.
Along with the three of them, the prosecutor of the Third Basic Public Prosecutor's Office in Belgrade, Boris Pavlović, did not come to the session, as he believes that "it is not appropriate for him to attend and decide on the elections since he was a candidate."
The law stipulates that the Council must make a decision within 48 hours of receiving the objection, otherwise the objections will be adopted automatically, and the elections at the polling stations to which the objections refer will be repeated. Out of a total of six objections, four refer to the alleged irregularities of the elections in Kragujevac.
