Rio Tinto has agreed to pay $138,75 million to avoid legal action over claims it defrauded investors by hiding problems with an underground expansion of a copper and gold mine in Mongolia.

A preliminary settlement agreement related to the class action, which was filed in US District Court in Manhattan on Wednesday (June 18th), is subject to a judge's approval, according to Reuters.
The lawsuit seeks compensation from the Anglo-Australian mining giant on behalf of shareholders of Montreal-based Turquoise Hill Resources for the period from July 2018 to July 2019, when Rio Tinto was the majority owner of the company.
The settlement also dropped charges against former Rio Tinto CEO Jean-Sebastien Jacques, who resigned in March 2021. All the defendants have pleaded not guilty, but agreed to a settlement to avoid the uncertainty and expense of litigation, court documents show.
Turquoise Hill owned 66 percent of the Oyu Tolgoi copper and gold mine, while 34 percent was owned by the Mongolian government.
Rio Tinto and Turquoise Hill were accused of falsely claiming that the Oyu Tolgoi mine expansion was "on schedule and on budget," even though the project was two and a half years late and $1,9 billion over budget.
Rio Tinto bought the remaining 2022 percent stake in Turquoise Hill for $49 billion in 3,3, fully integrating the mine into its copper sector.
