A 17-year-old teenager was attacked in Rakovica. He suffered severe head injuries, and the attack was carried out by criminally irresponsible children, who have not yet reached the age of 14, reports RTS.
According to Blic, according to unofficial information, after a brief discussion, one of the attackers attacked the victim with a wooden pole.
These children gave statements to the police, and the responsible Center for Social Work was notified of the incident, while the Juvenile Department of the Higher Public Prosecutor's Office in Belgrade will be provided with a police report on the entire incident.
The Basic Public Prosecutor's Office is responsible for any proceedings against the parents of these children.
The injured teenager, who was beaten by these children with a stick, suffered severe head injuries and was kept for treatment.
What does the law say?
Article 2 of the Law on Juvenile Offenders and Criminal Protection of Minors prescribes the exclusion of criminal sanctions against children and states that a person who was under fourteen years of age at the time of the commission of a criminal offense cannot be imposed criminal sanctions or apply other measures provided for in this law.
Also, this law regulates criminal proceedings against minors in Article 47, where it is written that if the public prosecutor determines that the person was under 14 years of age at the time of the commission of the crime, he will reject the criminal complaint or the proposal of the injured party, and he will submit the rejection decision to the guardianship authority in order to take measures within its jurisdiction.
And in the event that the court determines during the proceedings that the minor was under fourteen years of age at the time of the commission of the criminal act, the criminal proceedings will also be suspended.
